Draft pending legal review — not yet in effect.
Effective date: [effective date — to be confirmed]
These Terms of Service (“Terms”) are a binding agreement between you and [legal entity — to be confirmed], tax ID [tax ID — to be confirmed], [address — to be confirmed] (“TREDIA”, “we”). They govern your use of https://tredia.tech (the “Site”) and https://app.tredia.tech (the “Service”).
1. Acceptance
By creating an account, subscribing or using the Service, you accept these Terms and the policies they incorporate: Privacy, Cookies, Risk Disclosure, Refunds and Acceptable Use. If you do not agree, do not use the Service. You must be at least 18, or the age of majority where you live.
2. The Service
TREDIA is a subscription web terminal for financial market analysis: third-party data, charts, indicators, screeners, “signals”, the TREDIA Score, pattern backtests, watchlists, portfolio, alerts, educational games and, if enabled, an AI assistant. Features vary by plan and may change. TREDIA does not execute trades or hold your money or assets.
3. Accounts
One account per person. Keep your credentials confidential; you are responsible for activity under your account. Do not share it: simultaneous sessions are limited by plan. Tell us promptly at hello@tredia.tech about any unauthorized use.
4. Beta
The Service is in private beta, by invitation. Beta features may be incomplete, contain errors, or change or be withdrawn without notice; no service level applies, and we may end beta access at any time.
5. Subscriptions
5.1 Billing and automatic renewal. Paid plans are billed in advance, monthly or annually. Your subscription renews automatically for an equal period, charging the price then in effect to your payment method, until you cancel.
5.2 Cancellation. Cancel any time from the customer portal. Cancellation stops future renewals; you keep access until the end of the paid period.
5.3 Price changes. We will notify you of any price change by email in advance; it applies only from your next renewal. If you do not accept it, cancel before then.
5.4 Payments. Payments are processed by Stripe through its hosted checkout; your card details never reach TREDIA’s servers.
5.5 Taxes. Applicable taxes (VAT, IVA, sales tax) are calculated at checkout based on your location and shown before you pay.
5.6 Failed payments. If a charge fails, we may retry it and suspend paid features until it succeeds.
6. Refunds
Refunds are governed by the Refund Policy.
7. Acceptable use
You must comply with the Acceptable Use Policy, part of these Terms.
8. Intellectual property
The Site, the Service and their software, design, text, indicators, scores, methodologies and data compilations belong to [legal entity — to be confirmed] or its licensors. TREDIA® is a registered trademark and may not be used without our written consent, except to refer accurately to the Service. While subscribed, you have a limited, personal, non-exclusive, non-transferable, revocable license to use the Service. You keep the rights to content you enter and license it to us only to provide the Service.
9. Third-party data
Data comes from public sources (SEC EDGAR, FINRA, NASDAQ, FRED, BLS, BEA, U.S. Treasury) and licensed providers ([licensed data providers — to be confirmed]). It is provided “as is”: it may be delayed, incomplete, revised or wrong, and is not guaranteed to be real-time. Each data point shows its source and time; check both. Provider-specific terms are shown where they apply.
This product uses the FRED® API but is not endorsed or certified by the Federal Reserve Bank of St. Louis.
10. Not investment advice
Nothing in the Site or the Service is investment, financial, legal or tax advice, a recommendation, or an offer to buy or sell any asset. Read the Risk Disclosure. You are solely responsible for your decisions.
11. Disclaimer of warranties
To the maximum extent permitted by law, the Site and the Service are provided “as is” and “as available”, without warranties of any kind, including accuracy, availability, merchantability, fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, consequential or punitive damages, lost profits, trading or investment losses, or loss of data (including data stored only in your browser). Our total liability is limited to the amounts you paid us in the 12 months before the event giving rise to the claim. These limits do not apply to fraud, willful misconduct or non-waivable consumer rights.
13. Indemnification
To the extent permitted by law, you will indemnify [legal entity — to be confirmed] and its personnel against third-party claims arising from your breach of these Terms, misuse of the Service, or violation of law or third-party rights.
14. Suspension and termination
We may suspend or terminate your access, with notice where reasonable, for breach, non-payment, risk to the Service, or when required by law or a data provider. You may close your account at any time. If we terminate without cause, we refund prepaid fees for the unused period. Sections 8 to 13 and 16 survive termination.
15. Changes to these Terms
We will notify you of material changes by email or in the Service before they take effect. Continued use after that date means you accept them; if you do not, cancel before then.
16. Governing law, jurisdiction and consumer protection
These Terms are governed by the laws of [jurisdiction — to be confirmed], and the courts of [jurisdiction — to be confirmed] have jurisdiction; each party waives any other venue by reason of present or future domicile. This does not remove protections that the mandatory consumer law of your country gives you. Consumers in Mexico may file complaints with the Procuraduría Federal del Consumidor (PROFECO). If any provision is invalid, the rest remains in effect.
